Agreement to these terms
These Terms of Service (“Terms”) govern your use of the wpopw.com website, the WpopW account and customer portal, and the PopVid video-reply widget and other WpopW plugins (together, the “Services”). By creating an account, purchasing a plan or installing our plugins, you agree to these Terms. If you do not agree, do not use the Services. “WpopW”, “we” and “us” refer to the operator of wpopw.com; “you” refers to the account holder or site operator.
Definitions
A “Plugin” is any WpopW software product, including PopVid. The “Free edition” is the no-cost version distributed via WordPress.org; the “Pro edition” is the paid version unlocked by a license. A “License” is your right to use a Pro edition under a plan, and a “Membership” is your subscription giving access to that License and to updates.
Eligibility & your account
You must be able to form a binding contract to use the Services. You are responsible for the accuracy of your account details, for keeping your password secure, and for all activity under your account. Please notify us promptly of any unauthorized use.
Free and Pro editions
The Free edition is provided under the GPL and may display a “Powered by PopVid” badge. The Pro edition unlocks additional features (such as multiple skins, callback, statistics, targeting and CDN media hosting) for licensed sites. We may change which features belong to each edition over time.
License grant & site limits
Subject to these Terms and an active Membership, we grant you a non-exclusive, non-transferable license to install and use the Pro edition on the number of sites included in your plan, for as long as your Membership is active. You may use it on sites you own or that you build and manage for your clients.
Restrictions
You may not resell, redistribute, sublicense, rent or share your license or the Pro edition; remove or circumvent licensing or the plugin’s feature gating; reverse engineer the software except to the extent the law expressly allows; or use the Services to build a competing product. Using a single license across more sites than your plan allows may lead to suspension.
Subscriptions, billing & renewals
Pro Memberships are sold as yearly subscriptions. Unless you cancel, a Membership renews automatically at the end of each term at the then-current price, keeping your sites licensed and receiving updates. You can cancel renewal at any time from your account or by emailing info@wpopw.com; cancelling stops future charges but does not shorten the term you already paid for.
Payments & taxes
Prices are shown in US dollars unless stated otherwise and may exclude taxes, which are your responsibility where applicable. Card payments are handled by our payment provider; we store only limited billing metadata such as your plan, amount and the last four digits of your card. We may update prices, with changes applying to future terms.
Updates & support
While your Membership is active, licensed sites receive plugin updates through the WordPress dashboard, delivered from api.wpopw.com and verified against a checksum. We provide support by email at info@wpopw.com. We may add, change or remove features to improve the product or for security or legal reasons.
Media hosting & third-party services
If you enable CDN media hosting, your media is stored in your own Cloudflare R2 bucket using credentials you provide, and you are responsible for that account and its costs. The widget may load web fonts from Google and may link visitors to third-party destinations (such as WhatsApp or a phone dialer) that you configure; those services are governed by their own terms.
Your content & your end users
You are solely responsible for the content you display through the widget and for how you collect and use callback requests, phone numbers and other information from your own visitors, including obtaining any required consent and complying with privacy, marketing and calling/telemarketing laws. This data stays on your own WordPress site; we do not receive it. You will not use the Services for unlawful, infringing, deceptive or abusive purposes.
Intellectual property
The Services, including the Pro edition, our branding and our website content, are owned by WpopW or our licensors and protected by law. Except for the license granted above and the rights the GPL grants for the Free edition, no rights are transferred to you.
Affiliate program
If you take part in our affiliate program, the Affiliate Program Terms apply in addition to these Terms.
Disclaimers
The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. You use the Services at your own risk.
Limitation of liability
To the maximum extent permitted by law, WpopW will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim.
Indemnification
You agree to indemnify and hold WpopW harmless from claims, damages and expenses arising out of your content, your use of the Services, your handling of your visitors’ data, or your breach of these Terms.
Suspension & termination
You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, suspected fraud, or where required by law. On termination your license to the Pro edition ends, though the Free edition remains available under the GPL.
Refunds
Paid Memberships are covered by our Refund Policy, which forms part of these Terms.
Changes to these terms
We may update these Terms from time to time. We will change the “last updated” date and, for material changes, take reasonable steps to notify you. Continuing to use the Services after changes take effect means you accept the updated Terms.
